John, I don't agree. The original certificate is still valid until it's expiry. That doesn't mean the car couldn't be unroadworthy but it does still have a current MOT.
If that was the case there would be no point using the grace period of 1 month before certificate expiry.
People used to say the same even when there were only paper certificates.

Do you have any reference to suggest the cert is over-ruled.

Sorry no I am wrong.
Found the grace period in section 1 of the failure form notes.
Certificate remains valid.
What has changed is that if you continue to use the car during the grace period and get pulled over they will get a copy of failure list to check for using an unroadworthy car.

I don't think they will because all they get is a MOT valid, Yes/No flag on the database. As long as you are still within date of the original Cert, don't worry.

But they don't do a web search at the roadside, all they have is a database notification.

do they not have direct access to the database then? i thought it was all tied in with the numberplate recognition some vehicles are equiped with????

They do access the database, but that just gives an indication of a valid Cert or not. By performing a web search we can see the actual VOSA test information, but that's not what they reference.

Hi Dean

Read the MID regulations before you make your mind up on nosey or not.
In getting insurance quotes today I happened to be given a copy.
The Police vehicle seizure powers are draconian.
From now on I will carry photocopies of V5 or slip and bill of sale, valid MOT, Insurance certificate and personal identity information in any car I take on new or take off SORN. All car movements to MOT or for repair will have copies of the bookings as well.
The reason is that Police APNR teams will check against PNC, MID database and DVLA database. If a vehicle shows as not taxed or not insured, reported stolen or lost or if the registered keeper is wanted by the police for any other crimes they will be stopped and further checks will be made. The vehicle will be seized if there are no valid documents. If proof of ownership is not produced within 14 days of seizure the police have powers to crush and destroy the vehicle.
The costs of recovery from seizure are not cheap and best avoided. Making your way home without a car could be a pain.
I have had to correct 2 errors made by them on the DVLA data records for my cars in the last year. In each case a correction was made but they would not admit to an error having been made.

My old (complete shed of a) 306 was seized by the Police for no reason at some point, although they did return it with apologies after a bit of a bollocking. In the adventure it did however gain an impressive dent in the sill and silencer from where it had been moved with a forklift. Bastards :lol:
